Supreme Court Dismisses Banerjees’ Plea in School Jobs Scam Case

Context of the Case: On September 9, the Supreme Court made a significant ruling regarding the ongoing school jobs scam case, affecting Trinamool Congress (TMC) Member of Parliament Abhishek Banerjee and his wife Rujira Banerjee. Their petitions challenging the Enforcement Directorate (ED) summons were dismissed, posing a considerable challenge for the couple as they face serious allegations related to this high-profile case.

The Dismissal of Petitions

The Banerjees had contested the ED’s summons, asserting that New Delhi’s demand for their appearance was unwarranted since their primary residence is located in Kolkata. However, the Supreme Court, led by Justices Bela Trivedi and Satish Chandra Sharma, ruled that there was no illegality in the lower court’s orders, allowing the ED to continue its investigation without interruption.

   

The court stated, “We do not find any substance in the challenge raised by the appellants to the summons issued to them under section 50 of PMLA,” reinforcing the legitimacy of the ED’s proceedings. Additionally, the court clarified that any disobedience of ED’s directives could lead to serious legal consequences under the Indian Penal Code (IPC).

The Allegations of the Scam

The case centers around allegations of significant irregularities in the recruitment process of primary teachers in West Bengal. Investigations suggest that candidates paid bribes to secure their teaching positions, putting a spotlight on the integrity of the hiring process in the state’s education sector.

Abhishek Banerjee is reportedly associated with a firm named Leaps and Bounds, which is alleged to have played a critical role in diverting funds related to the recruitment scam. As the investigation unfolds, political tensions have escalated, with the TMC accusing the Central Government of misusing investigative agencies to target opposition leaders. The Investigation’s Background

The school jobs scam first gained prominence in July 2022 when the Central Bureau of Investigation (CBI) arrested former West Bengal education minister Partha Chatterjee along with several officials from the West Bengal School Service Commission. These arrests were made on suspicions of corruption and illegalities in teacher recruitment, triggering widespread public outcry and demands for accountability within the state’s educational framework.
