The Scope of the Investigation

According to CCI’s investigative report, it was determined that Amazon and Flipkart provided preferential treatment to selected retailers, thereby harming fair competition. These actions include substantial discounts on products that only certain brands offered on their platforms. Prominent companies such as Xiaomi, Motorola, Realme, and OnePlus have launched products through exclusive arrangements with Amazon, while similar practices have been identified for brands like Samsung, Lenovo, and others on Flipkart.

GV Siva Prasad, the Additional Director General of CCI, remarked, “Exclusivity in business is akin to a boycott, undermining the essence of free and fair competition and ultimately disadvantaging consumers.” While Xiaomi refrained from commenting on these allegations, other brands have not responded to inquiries.

The Role of E-Commerce Giants

Both Amazon and Flipkart have chosen to remain silent regarding these investigations. CCI has indicated that both companies attempted to refute the allegations of exclusive product launches during the investigation. However, officials have observed that exclusive launch strategies were prevalent in their operations. According to data from market research firm Counterpoint, Samsung and Xiaomi collectively hold about 36% of the Indian smartphone market, contributing to the overall e-commerce market, which reached approximately $60 billion last year and is projected to grow to $160 billion by 2028.
