Bharti Airtel’s Significant Payment to the Government

Bharti Airtel, a leading player in the Indian telecom sector, has recently made headlines by paying over Rs 84 billion to the Central Government. This substantial payment primarily addresses a portion of the outstanding spectrum dues that the company incurred after purchasing spectrum in a 2016 auction for approximately Rs 17,852 crore. Despite this large payment, Bharti Airtel has not disclosed the remaining amount it owes to the government.

Implications of the Supreme Court Ruling

In a recent development, the Supreme Court of India denied telecom companies’ requests for a recalculation of their outstanding amounts owed to the government. Bharti Airtel confirmed that the total payment made to the Telecom Department included an interest rate of 9.3 percent. Notably, in the first quarter of the current financial year, the company settled spectrum fees related to previous years, specifically those from 2012 and 2015.

The AGR Dues Challenge

   

According to analysts from the rating agency ICRA, Bharti Airtel and its competitor Vodafone Idea face a collective challenge of approximately Rs 1 lakh crore in outstanding Adjusted Gross Revenue (AGR) dues to the government. This figure encompasses both spectrum charges and licensing fees. In the past, these companies have contested the government’s methodology regarding the calculation of AGR dues, arguing that it should only include revenue generated from core services, while the government maintains that non-core revenue should also be factored in. This non-core revenue includes income from sources such as land rentals and sales.

The Supreme Court’s Stance

In a landmark ruling in 2019, the Supreme Court upheld the government’s definition of AGR calculation. The decision has proven particularly detrimental to Vodafone Idea, which reportedly owes around Rs 700 billion in spectrum charges and licensing fees, with the central government holding a 23.1 percent stake in the company as its largest shareholder.
