Competition Commission of India Takes Action Against Smartphone Giants
The Competition Commission of India (CCI) has launched a significant investigation into major smartphone manufacturers, including Samsung and Xiaomi, for alleged collusion with e-commerce giants Amazon and Flipkart. This scrutiny arises from claims that these companies engaged in anti-competitive practices by launching exclusive products on these platforms, undermining competition and harming consumers.
Understanding the Allegations
According to a report by Reuters, the CCI’s probe revealed that Amazon and Flipkart favored certain sellers, prioritized specific product listings, and offered substantial discounts that adversely affected other companies. Such actions contravene local competition laws designed to maintain a fair marketplace.
Exclusive Selling: A Problematic Practice
In a comprehensive 1,027-page report regarding Amazon, the CCI claims that Indian divisions of five major companies—Samsung, Xiaomi, Motorola, Realme, and OnePlus—collaborated with the e-commerce platform to introduce exclusively sold smartphones. Similarly, a 1,696-page report on Flipkart highlighted that local units of Samsung, Xiaomi, Motorola, Vivo, Lenovo, and Realme engaged in comparable exclusive selling practices. CCI’s Additional Director General, GV Shiva Prasad, articulated concerns that such exclusive arrangements violate the principles of free and fair competition and ultimately harm consumer interests. Additionally, the CCI pointed out that both platforms utilized foreign investments to offer selected sellers cost-effective warehousing and marketing services.
The Origin of the Investigation
The investigation into Amazon, Flipkart, and their associated sellers commenced in 2020, following a formal complaint by a large retailer association, the Confederation of All India Traders, which represents approximately 80 million members. Indian retailers have long contended that Amazon and Flipkart’s strategies, along with those of smartphone manufacturers, restrict access to the latest smartphone models, negatively impacting their retail businesses. Notably, research firm Datum Intelligence reported that online sales of smartphones surged to 50% last year, an increase from 14.5% in 2013. As it stands, Flipkart is projected to dominate 55% of online smartphone sales in 2023, with Amazon capturing an estimated 35% share.
Next Steps for the Companies Involved
In light of the findings, the CCI has mandated several smartphone makers—Xiaomi, Samsung, OnePlus, Realme, and Motorola—to submit their financial statements from the past three financial years, certified by auditors, by August 28. The CCI is expected to review objections raised by the involved companies, including Amazon, Flipkart, and the Retailer Association, before imposing any penalties or mandating changes to business practices.
