Elon Musk’s Social Media Platform X Complies with Brazilian Supreme Court Orders

In a significant turn of events, Elon Musk’s social media platform, X, has agreed to comply with the directives issued by the Supreme Court of Brazil. After a legal back-and-forth, X’s legal team confirmed that the company would adhere to the court’s demands, allowing it to resume operations in the country. This comes after X faced a ban in Brazil in late August due to its failure to manage hate speech effectively, as mandated by the court.

Background of the Case

Initially, X had resisted the Supreme Court’s orders, insisting that it would not comply. However, the Brazilian Supreme Court imposed a significant daily fine of 50,000 reais, approximately 8,900 US dollars, on anyone attempting to access the platform via a VPN. This stringent measure was introduced to curb the potential bypassing of the ban.

Legal Representation and Compliance

   

Following pressure from the court, X’s lawyers recently announced the appointment of a new legal representative in Brazil, fulfilling a crucial requirement set by the Supreme Court. Judge Alexandre de Moraes, overseeing the case, granted X a five-day window to provide the necessary documentation that substantiates the appointment of Rachel de Oliveira Conceição as its legal representative.

According to Brazilian regulations, foreign companies must designate a local legal representative to manage legal obligations within the country. X had previously maintained a legal representative until mid-August, after which it shuttered its offices and terminated its local staff.

The Ongoing Dispute

The conflict between Musk and Judge Moraes has been escalating for several months. Earlier in the year, the judge mandated X to block certain accounts implicated in disseminating misinformation and hate speech during Jair Bolsonaro’s presidency. Musk condemned this action as censorship and declined to comply. In response, the court took further actions, including freezing the financial accounts of Musk’s satellite venture, Starlink.

Financial Penalties and Future Steps

As part of the court’s rulings, X was subjected to a fine exceeding 3 million dollars, imposed as a prerequisite for lifting the operational ban in Brazil. Initially, X pronounced its intention to dismiss what it termed illegal orders, but the company’s legal representatives have now indicated their willingness to pay the stipulated fine and begin blocking specific accounts, complying with the court’s directives.
